If you are a DOT-regulated employer with safety-sensitive employees, yes — a formal program is federally required. For non-regulated businesses, it is not legally mandatory but strongly recommended. A properly documented program protects your business from liability and creates a safer workplace.
A DOT program is federally mandated for regulated industries — CDL drivers, aviation, transit, railroad, pipeline, and maritime workers. It must follow strict federal protocols under 49 CFR Part 40. A Non-DOT program is employer-designed for all other businesses. Both use certified collectors and SAMHSA labs — the difference is the regulatory framework.
For DOT programs, we manage your random pool and conduct draws at the federally required annual rates — currently 50% for drug testing and 10% for alcohol testing under FMCSA. For Non-DOT programs, we work with you to set the selection rate and manage the draws. When an employee is selected, we notify your HR team and dispatch a collector.
For DOT programs, the employee is immediately removed from safety-sensitive duties and must complete a return-to-duty process with a Substance Abuse Professional (SAP) before resuming work. For Non-DOT programs, the response is governed by your company's written drug policy. We provide all documentation needed for your HR process.
We are on-call 24 hours a day, 7 days a week. For DOT post-accident situations, we prioritize immediate dispatch — alcohol testing must occur within 8 hours and drug testing within 32 hours of a qualifying accident. We take those deadlines seriously.
